These Terms and Conditions of Use (“Terms of Use”) are made between Badael Company defined as (“Badael,” “We,” “Our,” “Us”) and its customers defined as (“Customer/s” or “You” or “Your”), to govern your access to and use of this site or platforms (as defined below) including all information, tools, and services available through it. By accessing or using the site or platform, you agree to these Terms of Use and our Privacy Policy. Badael company established under the laws of the Kingdom of Saudi Arabia, with Commercial Registration Number 1010798025, and its principal place of business located at Abi Bakr Alsiddiq, Alyasmin, Riyadh 13322.

The services and the information obtained through this site do not alter, modify, or supersede the terms or conditions of any other agreement you may have with Badael company or any of its subsidiaries or Affiliates. These Terms of Use (together with any documents referred to herein) set out the terms under which you may access and use, whether as a guest or as a registered user on Badael website or its product website and its social media pages or other technologies platforms in whatever form.

These Terms of Use constitute a legally binding agreement between Badael company and its customers, outlining their respective rights and obligations. When read in conjunction with our privacy policy, these Terms setting forth rights and obligations for our interactions with you, including the collection, processing, and use of personal data.

Prior to accessing, browsing, or registering in our website and/ or our platforms, it is imperative to carefully read these Terms of Use and our privacy policy. These documents govern your access to and interaction with our website or platforms. By using our website and/ or platforms, you acknowledge and agree to be bound by these terms and conditions. If you do not consent to these terms and conditions, you are prohibited from accessing, browsing, registering, or using our website and/ or our platforms.

Age Restriction

Our products are only for individuals aged 18 and older. By using our website and/ or platforms or purchasing our products, you confirm that you meet this age requirement.

Personal Use

All DZRT products are strictly for personal use. You are permitted to use one pouch at a time, and reselling or distributing the product in any form or by any unauthorized individual or entity is strictly prohibited.

Pricing

The official retail price for our product, 'DZRT,' is SAR 15 per can. Any price adjustments must be explicitly authorized by Badael Company. Unauthorized sales of our product, premature release announcements, or the sale of our products at prices deviating from those officially published on our website will constitute a violation of our terms and conditions therefore will be subject to Legal actions, including but not limited to lawsuits.

Liability and Responsibility

Badael company shall not be held responsible for any misuse of the products or for any harm resulting from improper use. We shall not be liable for any products purchased through unauthorized resellers, and users are encouraged to purchase products only through authorized platforms.

Misuse and Unauthorized Sales

Any misuse of DZRT products or sales made through unauthorized channels will result in legal consequences. Badael will not bear any liability for products purchased through unauthorized sellers.

Data Protection and Privacy

1. Personal Data Protection Law (PDPL) Compliance We are committed to protecting your personal data and ensuring compliance with the Personal Data Protection Law (PDPL), as well as other applicable laws and regulations in the Kingdom of Saudi Arabia. By using our Platforms and providing your personal information, you consent to the collection, storage, and processing of your data in accordance with these laws.
2. Data Collection We collect, store, and process personal data such as your name, email address, and any other relevant information that you voluntarily provide to us while using our Platforms. This data is used solely for providing services, communicating with you, and improving our offerings.
3. Data Security We employ industry-standard security measures and comply with regulations set by the National Cybersecurity Authority (NCA) and Saudi Data and Artificial Intelligence Authority (SDAIA) to protect your personal information from unauthorized access, disclosure, or theft. However, despite our best efforts, we cannot guarantee absolute security, and you provide data at your own risk.
4. Data Sharing and Third Parties We do not sell, trade, or otherwise transfer your personal data to third parties, except when required by law or in situations where third-party service providers assist in operating our Platforms. Any data shared with third parties will be in accordance with applicable laws and for the purpose of delivering services effectively.
5. Data Retention Your personal data will be retained only for as long as necessary to fulfill the purposes for which it was collected, in compliance with local laws and regulations. We will delete or anonymize data when it is no longer needed.
6. Data Subject Rights You have the right to access, rectify, erase, restrict processing of, and object to the processing of your personal data. You also have the right to data portability and to withdraw consent where processing is based on consent.
7. Data Breach We will notify you and relevant authorities without undue delay in case of a high-risk data breach.

Nafath Integration and Data Handling

1. Nafath Authentication We use the Nafath government app for secure user authentication and data protection. By using our platforms, you consent to authenticate via Nafath, which involves national ID verification.
2. Data Collection and Updates The Nafath application will provide us with relevant data to update existing customers' information and gather data for newly registered customers, including:
   • Full name (in Arabic and English)
   • Date of birth
   • Gender
   • National ID number
   • Place of issue
   • Nationality
3. Data Protection Compliance We are committed to protecting your data in accordance with the Personal Data Protection Law (PDPL) and other applicable regulations. The data obtained through Nafath will be treated with the same level of security and confidentiality as outlined in our Data Protection and Privacy section.
4. User Responsibility You are responsible for ensuring that the information you provide through Nafath is accurate and up-to-date. Any discrepancies may affect your ability to use our services.
5. Withdrawal of Consent You may withdraw your consent to collect and process your data through Nafath at any time, subject to legal and contractual obligations. This may limit your ability to access certain services.

Shipping Terms

We are dedicated to delivering your orders promptly and efficiently. However, please note the following regarding our shipping and refund policy:

1. Delivery Attempts: We will attempt to deliver your order three times. If the item is not successfully delivered after these attempts, we reserve the right to withhold a full refund.
2. Refund Exclusions: If the item is not delivered after three attempts, we will issue a refund for the cost of the item, excluding any shipping charges.
3. Customer Responsibility: The customer is responsible for providing accurate delivery information and being available for delivery during the designated times.
4. Communication: We are committed to keeping you informed. We will make every effort to communicate delivery attempts and provide updates regarding your order status.

Customer Compliance

We have the right to block or suspend access to our services for any customer who fails to comply with our Terms and Conditions.

Return and Refund Policy:

Customers have a maximum of seven (7) days for normal orders and fifteen (15) days for subscription orders from the date of delivery and/or purchase to request a return and refund for the following accepted reasons:

1. If you receive an item that does not match your order.
2. If the item arrives damaged or defective.

Customers must present a valid receipt as proof of purchase when requesting a refund for items purchased at our retail locations.

Make sure to submit all return requests within this timeframe to be eligible for a refund.

Compliance with Saudi Cybersecurity Regulations

We ensure compliance with the National Cybersecurity Authority (NCA) and Saudi Data and Artificial Intelligence Authority (SDAIA) regulations in the Kingdom of Saudi Arabia, including the implementation of best practices for securing personal and organizational data from cyber threats and breaches.

Intellectual Property Rights

In these Terms of Use, “Intellectual Property Rights” means all intellectual property rights and includes: Copyright, patents, database rights, and rights in trademarks, designs, know-how, and confidential information (whether registered or unregistered). Badael owns (and where applicable is the licensee of) all Intellectual Property Rights in the Content. All rights, including those not expressly granted, in and to the Platforms and the Content accessible thereon, are reserved by Badael. Except as otherwise described herein, nothing on Our Platforms shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo displayed on the Platforms without Our prior written permission.

Use of Content on the Platforms

You may access, copy, download, and print the Content contained on Our Platforms for your personal and non-commercial use, provided You do not modify or delete any copyright, trademark, or other proprietary notice that appears on the Content You access, copy, download, or print.

Limitation of Liability

To the fullest extent permitted by the laws of Saudi Arabia, Badael excludes all liability for any loss, damage, or injury arising from the misuse of our website, products, or services, including but not limited to any indirect, incidental, special, consequential, or punitive damages.

Applicable Law

The laws of the Kingdom of Saudi Arabia will govern these Terms of Use, and the competent courts of the Kingdom of Saudi Arabia shall have exclusive jurisdiction over any disputes arising from these Terms of Use.

DZRT Challenge

1. DZRT is organizing the "DZRT Challenge" (the "Campaign") during the FIFA World Cup 2026 period. This Campaign is an independent promotion organized solely by DZRT. It is not affiliated with, endorsed by, or sponsored by FIFA or the FIFA World Cup 2026™ in any way. All references to the FIFA World Cup 2026 are made for informational and contextual purposes only. Participation in the Campaign is subject to these Terms and Conditions. By participating, each participant agrees to be bound by them.
2. Campaign Period: The Campaign will commence on June 7, 2026 and end on July 20, 2026. DZRT reserves the right to amend, suspend, extend, shorten, or terminate the Campaign at any time at its sole discretion.
3. Eligibility To participate in the Campaign, a participant must:

• Be eighteen (18) years of age or older, in accordance with DZRT's policies and applicable regulations.
• Be a resident of the Kingdom of Saudi Arabia.
• Maintain an active and valid DZRT account.
• Comply with these Terms and Conditions and any applicable Campaign instructions.
• DZRT reserves the right to request proof of identity, age, residency, or eligibility at any time.

4. Participation & Free Entry: The Campaign consists of interactive games and activities through which participants may earn points and compete for weekly prizes. Participation in this Campaign is entirely free of charge. No purchase is required to participate or to be eligible to win any prize. Participants must be logged into their DZRT account to access and participate in any Campaign activity.
5. Points: Points are awarded in accordance with the scoring mechanisms implemented within the Campaign. DZRT may, at its discretion, introduce additional opportunities to earn points through eligible activities, promotions, or subscriptions during the Campaign period. DZRT reserves the right to review, adjust, correct, or remove any points awarded as a result of technical, operational, or administrative errors.
6. Leaderboard

• The Leaderboard displays the top twenty (20) participants.
• A logged-in participant's ranking will always remain visible regardless of overall position.
• The Leaderboard resets weekly every Sunday at 12:00 AM KSA time.

7. Winner Selection Weekly winners are determined based on Leaderboard standings recorded at 11:59 PM KSA time each Saturday. In the event of a tie, the participant who achieved the relevant score first, as determined by DZRT's timestamp records, shall rank higher. Once a participant has won a prize during the Campaign, they will not be eligible to win again during the Campaign period. The prize may be awarded to the next eligible participant.
8. Prizes: Prizes are awarded according to the final ranking of eligible participants. Prizes are non-transferable, non-exchangeable, and may not be redeemed for cash unless otherwise determined by DZRT. DZRT reserves the right to substitute any prize with another of equal or greater value if necessary.
9. Winner Verification All prizes are subject to eligibility verification and compliance with these Terms and Conditions. DZRT reserves the right to withhold, cancel, or revoke any prize if a participant is found to have violated these Terms and Conditions or engaged in any fraudulent, dishonest, or abusive conduct.
10. Disqualification & Fraud Prevention DZRT may disqualify any participant, remove points, or cancel prize eligibility in the event of:

• Creating or using multiple accounts to gain an unfair advantage.
• Manipulating or attempting to manipulate game results, scoring systems, or Campaign mechanics.
• Using automated tools, scripts, bots, or any unauthorised methods.
• Violating these Terms and Conditions or any Campaign instructions issued by DZRT.

11. Limitation of Liability: DZRT shall not be liable for any interruption, delay, technical malfunction, network failure, system error, or other issue beyond its reasonable control that may affect participation, scoring, or prize allocation.
12. Amendments and Termination: DZRT reserves the right to amend these Terms and Conditions, suspend the Campaign, or terminate the Campaign at any time. Any amendments shall become effective upon publication through DZRT's official channels.
13. Governing Law: These Terms and Conditions are governed by the laws and regulations of the Kingdom of Saudi Arabia. Any dispute arising out of or in connection with the Campaign shall be subject to the exclusive jurisdiction of the competent courts of the Kingdom of Saudi Arabia.
